These SMS Terms & Conditions (“Terms”) govern your consent to receive Short Message Service (SMS) text messages from Alpha Credit Corp (“we,” “us,” or “our”). By checking a consent box on the SMS Opt-In Form and/or by responding to any opt-in prompt, you agree to these Terms.
1. Program Description.
Alpha Credit Corp operates two separate SMS messaging programs: (a) a Transactional SMS Program for account-related and loan servicing communications, including payment reminders and account notifications; and (b) a Marketing & Promotional SMS Program for offers regarding additional loan funds, refinancing opportunities, and other promotions. Enrollment in one program does not constitute enrollment in the other.
2. Consent Requirement.
Participation in either SMS program is entirely voluntary. Your consent to receive SMS messages is not required as a condition of obtaining a loan, product, or service from Alpha Credit Corp.
3. Message Frequency.
Message frequency may vary depending on your account activity and the program(s) in which you are enrolled. Transactional messages will be sent as relevant account events occur. Marketing messages will be sent periodically, as determined by Alpha Credit Corp.
4. Message and Data Rates May Apply.
Standard message and data rates charged by your mobile wireless carrier may apply to each SMS message sent to or received from Alpha Credit Corp. Alpha Credit Corp is not responsible for any such charges. Contact your wireless carrier for details about your plan.
5. Supported Carriers.
Alpha Credit Corp’s SMS programs are available on most major U.S. wireless carriers. We cannot guarantee delivery on all carriers or devices.
6. Carriers Are Not Liable for Any Delayed or Undelivered Messages.
Alpha Credit Corp and participating wireless carriers are not responsible for any undue delays, failure of delivery, errors, or losses of any messages transmitted via SMS. Carrier liability is expressly disclaimed.
7. Opt-Out Instructions — STOP.
To stop receiving SMS messages from either or both programs at any time, reply STOP to any SMS message you receive from Alpha Credit Corp. Upon receipt of your STOP message, we will send you a final confirmation message and you will be unenrolled from the applicable program(s). If you are enrolled in both programs, replying STOP will unenroll you from both. 8. Help Instructions — HELP.

9. Authorized User.
You represent and warrant that you are the owner or authorized user of the mobile device and phone number provided. If your cell phone number changes, you must notify Alpha Credit Corp immediately. You are solely responsible for any unauthorized use of your phone number.
10. Modification or Termination of Program.
Alpha Credit Corp reserves the right to modify, suspend, or terminate either SMS program at any time, with or without notice. We may also update these Terms at any time. Continued participation in a program following any such update constitutes your acceptance of the revised Terms.
11. Governing Law.
These Terms are governed by the laws of the United States and the state in which Alpha Credit Corp operates, without regard to conflict of laws principles.
